Missouri has a Consumer Protection Lemon Law that establishes guidelines for manufacturers to repurchase or replace defective automobiles. Automobile owners should read eligibility and notice requirements and be mindful of available remedies if a dealer cannot meet the vehicle warranty after repeated repair attempts. A consumer should give a dealer three attempts to repair under the warranty before pursuing a Lemon Law claim. When you purchase a vehicle, the dealer is required to provide you with literature including information regarding your rights under your state’s Lemon Laws.

Contract Terms Entered into on the Internet

A recent Missouri Court of Appeals decision reminds us that contracts entered into over the internet may bind us to certain terms and conditions in the same manner as if signing a paper contract. On many websites there are notices that state “By submitting you agree to the Terms of Use” next to a “Submit” button of some type. By selecting “Submit”, the Missouri Appellate Court has found that you are agreeing to the terms of use referred to, no matter whether you actually took the time to read those terms.
