Most personal injuries in Missouri result from negligence. This is defined as the level of care that a reasonable person would have exercised in a certain situation to avoid a foreseeable risk of harm. Negligence may also arise from inaction when a duty to act exists. Wrongful death occurs when a person or business acts negligently or recklessly, and an individual is killed as a result. Certain family members of the person who was killed may be entitled to recover for their loved one’s pain and suffering as well as lost wages, medical bills, funeral expenses, and loss of consortium. In limited circumstances, punitive damages designed to punish especially reckless conduct may also be recovered.
